致美國國會參眾兩院

各位議員！

美國聯邦眾議院7月25日通過《臺灣國際團結法》，法案解讀了聯合國大會第2758號決議，認定該決議僅處理中國代表權問題，但並未處理臺灣與臺灣人民在聯合國或任何相關組織的代表權問題，亦沒有在中華人民共和國（簡稱中共國）與臺灣關繫上採取立場，或包含任何關於臺灣主權的聲明。

因此，法案要求在2020年3月生效的《臺灣友邦國際保護及加強倡議法》(簡稱臺北法，TAIPEI Act），中加入美國「倡議國際組織抗拒中華人民共和國扭曲《一個中國》立場」的文字，要求聯邦政府在所有國際組織的代表運用美國的發言權、表決權和影響力倡議這些組織抗拒中華人民共和國試圖扭曲涉及臺灣的抉定、文字、政策或程序。並要求聯邦政府鼓勵美國的盟友反對中國削弱臺灣與其他國家的外交關系與夥伴關系的作為，以及阻礙臺灣參與國際組織的行為。 

我們對美國眾議院幫助臺灣人民和臺灣現政府以對抗中共一直以來的壓製和威脅的努力表示贊賞，同時也感到十分遺憾！

遺憾之一：法案沒有正視事實，即臺灣目前的政府是中華民國政府，而不僅僅是臺灣。

遺憾之二：法案可以超越只是解釋2758號決議的侷限，撤底否定和取消中共操弄由兩阿提出的文理不通、邏輯混亂的2758號決議。

理由如下：

首先、決議標題是：恢復中華人民共和國的合法權利。但中共國從來就不是聯合國的會員國，恢復合法權利一說純粹是無中生有的無稽之談。

第二、決議說：「承認中華人民共和國政府的代表是中國在聯合國組織的唯一合法代表，」。這一說法沒有法律依據。

中華民國是(1912年10月10日)辛亥革命後建立的亞洲第一個民主共和國，簡稱民國。美國在1913年承認中華民國，是第一個承認這個共和體製政權的外國政府。中華民國在反法西斯的戰爭中作出巨大貢獻，並且是聯合國發起、創始國之一。

中華民國參與聯合國和平憲章的製定，並且是第一個在憲章的中、法、俄、英、西5種聯合國正式語言文件上簽字。迄今為止，中華民國作為主權獨立的國家，依然存在於國際社會之中。沒有違反聯合國憲章的行為。在美國國家檔案庫裡迄今還保存著中華民國代表簽署的聯合國憲章中文文本。聯合國沒有任何文件指明取消中華民國作為聯合國成員國的文件。因此承認中共國代表「是中國在聯合國組織的唯壹合法代表」，從邏輯上來說是不能成立的。

請各位議員註意：（《聯合國憲章》(United Nations Charter)

第十九章批準及簽字第110條規定：

一、本憲章應由簽字國各依其憲法程序批準之。 

二、批準書應交存美利堅合眾國政府。該國政府應於每一批準書交存時通知各簽字國，如本組織秘書長業經委派時，並應通知秘書長。 

三、一俟美利堅合眾國政府通知已有中華民國、法蘭西、蘇維埃社會主義共和國聯邦、大不列顛及北愛爾蘭聯合王國、與美利堅合眾國、以及其他簽字國之過半數將批準書交存時，本憲章即發生效力。美利堅合眾國政府應擬就此項交存批準之議定書並將副本分送所有簽字國。 

四、本憲章簽字國於憲章發生效力後批準者，應自其各將批準書交存之日起為聯合國之創始會員國。）

當年，中華民國政府按憲法程序批準及簽字，並將批準書交存美利堅合眾國政府。迄今為止未見中華人民共和國提交《聯合國憲章》批準書。可見中華人民共和國從來沒有承認過聯合國和平憲章。

所以決議說：承認中華人民共和國政府的代表是中國在聯合國組織的唯壹合法代表的說法是很荒謬的！

第三、決議稱中共國取得聯合國合法席位「對於維護聯合國憲章和聯合國組織根據憲章所必須從事的事業都是必不可少的，」意思是中共掌控的中共國是維護聯合國憲章的重要力量，不可或缺。

事實正好相反，聯合國憲章開宗明義「重申基本人權，人格尊嚴與價值，以及男女與大小各國平等權利之信念，」而仿照蘇聯模式建立的中共國從誕生之日開始就剝奪了大陸人民的基本人權，就肆意踐踏大陸人民的人格尊嚴與價值。

中共一直在欺騙世界，1945年8月25日，中共發表《對目前時局的宣言》明確提出：「和平、團結、民主」的口號。1945年10月10日，中共代表與中華民國政府代表在重慶簽署了《雙十協定》，承認和平建國的基本方針，同意以對話方式解抉一切爭端。長期合作，以和平、民主和團結為基礎，堅抉避免內戰，建設獨立、自由和富強的新中國，撤底實行三民主義。

但實際上卻在蘇聯的全方位支持下，用暴力把經歷抗戰已經精疲力盡的中華民國政府趕到了臺灣。

歷史已經證明：蘇共和中共等用暴力獲得了馬克思的共產主義理論「七十年的試驗期」，但蘇聯和「共產國際」的瓦解，宣告了馬克思共產主義理論的撤底失敗。

請回顧一下歷史，美國50年前協助中共國取得聯合國席位之後，中共國恩將仇報：50年後中共反對美國重返聯合國教科文組織。可見農夫與蛇的故事在美國人身上發生。                          

中共在獲得聯合國席位後，肆無忌憚的向各民主國家尤其是向美國進行滲透，並向聯合國各個機構滲透，迄今實際已操控了許多機構和部門。中共意圖以極權專製的價值觀改變國際秩序，改變世界的野心已昭然若揭。已經成了文明世界的威脅！

因此，中共和蘇共壹樣是破壞聯合國憲章的力量！不僅不應授予聯合國的合法席位，即便擁有也應加以取消。

第四、決議決定：「把蔣介石的代表從它在聯合國組織及其一切機構中….驅逐出去」。

阿爾巴尼亞聯合國代表團團長雷茲·馬利列（ReizMalile）接受新華社記者採訪時說到：「我們把擬定的策略及抉議草案交給了中國時任駐地拉那大使劉振華，請他送交北京，徵求中方的最終意見。幾天後，中國大使到阿爾巴尼亞外交部，向我通報說，中方完全同意提案及我們考慮採取的策略：立刻將蔣介石的代表從其在聯合國與所有附屬組織非法佔有的席位逐出。

」決議中的「蔣介石的代表」、「非法佔有的席位」等用詞，是典型的中共文革時期的語言特徵。

這一決定是非常錯誤的。1923年8月，蔣介石赴蘇聯考察軍事政治和黨務。就看清了：「蘇維埃政治製度乃是專製和恐怖的組織。」這足以說明，蔣介石是站在民主世界一邊的。國共之爭本質上是民主與專製之爭，中華民國的抗共戰爭理應得到國際民主社會的支持，但這種支持力度不夠，美國有些短視的政客甚至提出接納中共，拋棄國府的主張。導致了對華政策的傾斜。

因此，即便退一步講，這個決定可以成立，也沒有取消中華民國的聯合國會員資格。所以現在是時候，驅逐中共國的代表，讓中華民國代表回歸了！

麥克阿瑟元帥曾在國會指證認為：對華戰略的失策，引起一連串災難，是美國百年來政治的最大敗筆。他重複地告誡赤禍的危害性：「我們未來幾代人要為此付出代價：或許要一百年之久。」麥帥的預言已經被證實。

綜上所述，中共構成日益增長的威脅，始於聯合國荒腔走板的第2758號決議，而廢止聯合國荒腔走板的第2758號決議將是減弱直至最終消除中共的威脅的開始！

據此，我們呼籲美國國會的參眾兩院推出廢止聯合國2758號決議的法案，並籲請盟國一起努力，聯合向78屆聯合國大會遞交提案，要求大會討論並廢止不合理且有損聯合國和平憲章的2758號決議。

The U.S. House of Representatives passed the “Taiwan International Solidarity Act” on July 25. The bill interpreted UN General Assembly Resolution 2758 and determined that the resolution only dealt with the issue of China’s representation, but did not deal with Taiwan and its people in the UN or any related organizations. The issue of representation, nor does it take a position on the relationship between the People’s Republic of China (referred to as the PRC) and Taiwan, or contain any statement about Taiwan’s sovereignty.

Therefore, the bill requires that the “Taiwan Friendship International Protection and Strengthening Initiative Act” (referred to as the Taipei Act, TAIPEI Act), which came into effect in March 2020, add the text of the United States “advocating international organizations to resist the People’s Republic of China’s distortion of the “One China” position” , requiring representatives of the Federal Government in all international organizations to use the voice, voting rights, and influence of the United States to advocate for these organizations to resist attempts by the People’s Republic of China to distort decisions, texts, policies, or procedures involving Taiwan. And ask the federal government to encourage U.S. allies to oppose China’s efforts to weaken Taiwan’s diplomatic relations and partnerships with other countries, and to hinder Taiwan’s participation in international organizations.

We appreciate the efforts of the U.S. House of Representatives to help the people of Taiwan and the current government of Taiwan to fight against the CCP’s continuous suppression and threats, but also regret it!

One of the regrets: the bill does not face up to the fact that Taiwan’s current government is the government of the Republic of China, not just Taiwan.

Regret No. 2: The bill can go beyond the limitation of merely explaining Resolution 2758, and completely negate and cancel the CCP’s manipulation of Resolution 2758, which was proposed by the , Albania and Algeria . This bill is incomprehensible and logically confusing.

The reasons are as follows:

First, the title of the resolution is: Restoration of the Legal Rights of the People’s Republic of China. But PRC has never been a member state of the United Nations, and the idea of restoring legal rights is pure nonsense.

Second, the resolution says: “The representative of the Government of the People’s Republic of China is recognized as the only legal representative of China in the United Nations Organization.” This claim has no legal basis.

The Republic of China is the first democratic republic in Asia established after the Revolution of 1911 (October 10, 1912), referred to as the Republic of China. The United States recognized the Republic of China in 1913 and was the first foreign government to recognize this republican regime. The Republic of China made great contributions to the anti-fascist war and was one of the founding countries of the United Nations.

The Republic of China participated in the formulation of the United Nations Peace Charter, and was the first to sign the Charter in five official languages of the United Nations: Chinese, French, Russian, English, and Spanish. So far, the Republic of China, as a sovereign and independent country, still exists in the international community. No violation of the Charter of the United Nations. The Chinese version of the Charter of the United Nations signed by the representatives of the Republic of China is still preserved in the National Archives of the United States. There is no document in the United Nations that specifies the cancellation of the Republic of China as a member of the United Nations. Therefore, it is logically untenable to admit that the Chinese representative “is the only legal representative of China in the United Nations Organization”.

Attention Members of Parliament: (United Nations Charter

Chapter 19 Ratification and Signature Article 110 stipulates:

1.The present Charter shall be ratified by the signatory states in accordance with their respective constitutional processes.

2.The ratifications shall be deposited with the Government of the United States of America, which shall notify all the signatory states of each deposit as well as the Secretary-General of the Organization when he has been appointed.

3.The present Charter shall come into force upon the deposit of ratifications by the Republic of China, France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland, and the United States of America, and by a majority of the other signatory states. A protocol of the ratifications deposited shall thereupon be drawn up by the Government of the United States of America which shall communicate copies thereof to all the signatory states.

4.The states signatory to the present Charter which ratify it after it has come into force will become original Members of the United Nations on the date of the deposit of their respective ratifications.)

That year, the government of the Republic of China ratified and signed it in accordance with constitutional procedures, and deposited the instrument of ratification with the government of the United States of America. So far no instrument of ratification of the Charter of the United Nations has been submitted by the People’s Republic of China. It can be seen that the People’s Republic of China has never recognized the United Nations Peace Charter.

So the resolution said: It is absurd to admit that the representative of the government of the People’s Republic of China is the only legal representative of China in the United Nations organization!

Third, the resolution stated that China’s acquisition of a legal seat in the United Nations is “essential for the maintenance of the United Nations Charter and the cause that the United Nations organization must engage in in accordance with the Charter,” which means that China under the control of the CCP is an important force for the maintenance of the United Nations Charter. Can’t been indispensable.

The fact is just the opposite. The UN Charter clearly states that it “reaffirms basic human rights, human dignity and value, and the belief in equal rights between men and women and nations of all sizes,” while the CCP, which was established on the model of the Soviet Union, has deprived the people of the mainland of basic human rights since its birth. It wantonly tramples on the personal dignity and value of the mainland people.

The CCP has been deceiving the world. On August 25, 1945, the CCP issued the “Declaration on the Current Situation” and clearly stated the slogan of “peace, unity, and democracy.” On October 10, 1945, representatives of the Communist Party of China and the government of the Republic of China signed the “Double Ten Agreement” in Chongqing, recognizing the basic policy of peaceful nation building and agreeing to resolve all disputes through dialogue. Long-term cooperation, based on peace, democracy and unity, resolutely avoid civil war, build an independent, free and prosperous new China, and implement the Three Principles of the People.

But in fact, with the full support of the Soviet Union, the government of the Republic of China, which had been exhausted from the war of resistance, was driven to Taiwan by the CCP ‘s violence.

History has proved that the Communist Party of the Soviet Union and the Communist Party of China used violence to obtain the “seventy-year trial period” of Marx’s communist theory, but the collapse of the Soviet Union and the “Comintern” declared the failure of the dismantling of Marx’s communist theory.

Please look back at history. After the United States assisted China in obtaining a seat in the United Nations 50 years ago, CCP repays favor with evil: 50 years later, the CCP opposes the return of the United States to UNESCO. It can be seen that the story of the farmer and the snake happened to the Americans.

After obtaining a seat in the United Nations, the CCP unscrupulously infiltrated into various democratic countries, especially the United States, and infiltrated into various United Nations agencies. So far, it has actually controlled many agencies and departments. The CCP intends to change the international order with totalitarian and authoritarian values, and its ambition to change the world has been clearly revealed. CCP as become a threat to the civilized world!

Therefore, the CCP, like the CPSU, is a force that undermines the Charter of the United Nations! Not only should it not be granted a legitimate seat in the United Nations, but even if it has one, it should be abolished.

Fourth, the resolution decides to “expel Chiang Kai-shek’s representatives… from the United Nations organization and all its agencies”.

Reiz Malile, head of the Albanian United Nations delegation, said in an interview with Xinhua News Agency: “We handed over the proposed strategy and draft resolution to Liu Zhenhua, the then Chinese ambassador to Tirana, and asked him to send Beijing, to seek the final opinion of the Chinese side. A few days later, the Chinese ambassador came to the Albanian Ministry of Foreign Affairs and informed me that the Chinese side fully agreed with the proposal and the strategy we were considering: Immediately expel Chiang Kai-shek’s representatives from their illegally occupied seats in the United Nations and all affiliated organizations.

The words “representative of Chiang Kai-shek” and “illegally occupied seats” in the resolution are typical language features of the CCP’s Cultural Revolution period.

This decision was very wrong. In August 1923, Chiang Kai-shek went to the Soviet Union to inspect military, politics and party affairs. He saw it clearly: “The Soviet political system is an autocratic and terrorist organization.” This is enough to show that Chiang Kai-shek is on the side of the democratic world. The struggle between the Kuomintang and the Communist Party is essentially a struggle between democracy and dictatorship. The Republic of China’s anti-communist war deserved the support of the international democratic community, but this support was insufficient. Some short-sighted politicians in the United States even proposed to accept the CCP and abandon the government. leading to a tilt in China policy.

Therefore, even if we take a step back and say that this decision can be established, it does not cancel the membership of the Republic of China in the United Nations. So now is the time to expel the representatives of the Chinese Communist Party and let the representatives of the Republic of China return!

Marshal MacArthur once testified in Congress that: the failure of the China strategy caused a series of disasters, which is the biggest political failure of the United States in the past century. He repeatedly warned of the dangers of the Red Plague(Red disaster): “Our future generations will have to pay the price for this: it may take a hundred years.” MacArthur’s prediction has been confirmed.

To sum up, the growing threat posed by the CCP began with the United Nations’ sloppy Resolution 2758, and the abolition of the UN’s sloppy Resolution 2758 will be the beginning of weakening and eventually eliminating the CCP’s threat!

Accordingly, we call on the House and Senate of the U.S. Congress to introduce a bill to abolish UN Resolution 2758, and call on allies to work together to jointly submit a proposal to the 78th session of the UN General Assembly, asking the General Assembly to discuss and abolish unreasonable and damaging UN Peace Charter Resolution 2758.
